The court also ordered that the entire function has to be video-recorded and if it is found that the petitioners indulge in any law and order situation, the permission to be granted to them will be affected in future.

The Bombay High Court has also asked the Shiv Sena to approach the BMC ward officer with this order and seek fresh permission as per the 2016 GR.
In 2016, the BMC commissioner was directed to grant permission to hold a Dussehra rally at Shivaji Park, and thereafter, permission was given to the Shiv Sena here till 2019. The rally was not held in 2020 and 2021 due to the COVID-19 pandemic.
Meanwhile, the Bombay High Court rejected the application of Chief Minister Eknath Shinde faction MLA Sada Sarvankar’s intervention in the petitions of Shiv Sena factions seeking permission for the Dussehra rally at Shivaji Park.
When the matter came up for hearing on Friday, the Thackeray faction’s lawyer Aspi Chinoy argued that the Shiv Sena has been organizing its annual Dussehra fair at Shivaji Park since 1966.
He argued that Shiv Sena has the right to organize Dussehra Mela (rally) as per the proposal of the government.
Chinoy further said that Shiv Sena has been organizing the fair there for 50 years. Such a proposal is distorted after tradition, custom and the venue for the Dussehra Mela by the Maharashtra government in 2016 is fixed.
The BMC had on September 21 said that it was rejecting the Thackeray-led party’s application as MLA Sada Saravankar, a rebel faction of Maharashtra Chief Minister Eknath Shinde-led Shiv Sena, has made a similar application and if permission is granted to one faction. So this will create law and order problem for the local police.
